DMCA Policy

This Digital Millennium Copyright Act ("DMCA") Policy describes the procedures for reporting claims of copyright infringement on the platform, website, or services operated by XPerf Inc. ("Company," "we," "our," or "us").
1. Policy Statement
We respect the intellectual property rights of others and expect users of our online bookkeeping and accounting software and related services ("Service") to do the same. It is our policy to respond to properly submitted notices of alleged copyright infringement in accordance with the DMCA (17 U.S.C. § 512).

3. Submitting a DMCA Notice of Infringement
If you believe that material located on or linked to our Service infringes your copyright, please send a written DMCA notice to our Designated Agent containing the following:
- Identification of the copyrighted work you claim has been infringed
- Identification of the material you believe is infringing and enough information to allow us to locate the material (including URL, if applicable)
- Your contact information, including your name, address, telephone number, and email address
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
- A statement made under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
- Your physical or electronic signature
Incomplete DMCA notices may not be processed.
4. Removal of Allegedly Infringing Material
Upon receipt of a valid DMCA notice, Company will promptly:
- Remove or disable access to the allegedly infringing material
- Notify the user who posted or stored the material of the removal
- Retain a record of the complaint
5. Counter-Notification
If you are a user whose material was removed under a DMCA notice, and you believe this was a mistake or misidentification, you may send a counter-notification to the Designated Agent containing:
- Identification of the material removed and its location before removal
- Your name, address, telephone number, and email address
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of a mistake or misidentification
- A statement that you consent to the jurisdiction of the federal court for your district and will accept service of process from the complaining party
- Your physical or electronic signature
If a valid counter-notification is received, Company may restore the material within 10-14 business days unless the original complainant files a court action.
6. Repeat Infringer Policy
Company may, in its sole discretion, terminate user accounts of repeat infringers, consistent with Section 512(i)(1)(A) of the DMCA.
7. Misrepresentations
Be advised that under federal law, anyone who knowingly makes false claims in a DMCA notice or counter-notice may be liable for damages, including attorney's fees.
8. Reservation of Rights
Company reserves the right to remove or disable any content alleged to infringe copyright, regardless of whether a formal DMCA notice is received, and to terminate any user's access to the Service in connection with copyright infringement.
